En el segundo momento, a partir de El más desdichado, se aborda la vivencia del aburrimiento en su relación con el tiempo. The article presents an approach to the problem of evil in the poetry of Georg Trakl. This is done from a reading of the Grodek poem. In the first place, the general problematic of Trakl’s poetry is contextualized, above all the tension between guilt and love. In a second moment, this problem is analyzed in Grodek read in historical and philosophical perspective, that is, the concretion of the evil understood as the destruction of humanity in the experience of the death (...) of God. In a third moment, the paradigmatic and paradoxical figure of said consummation appears; the unborn, an image repeated in the work of Trakl and with which, revealingly, culminates Grodek, his last poem. Este artículo es una revisión a la crítica que hace Hegel a la concepción de la naturaleza que subyace a la filosofía teórica y práctica de Fichte. En el escrito “Diferencia entre los Sistemas de Filosofía de Fichte y Schelling” (1801), Hegel dirige la reflexión hacia la relación de dominio y sometimiento que establece la filosofía de Fichte entre razón y naturaleza respectivamente. Tanto así, que ésta se convierte en la base de la deducción del derecho natural, que tiene como (...) propósito mostrar la posibilidad de la autoconciencia y, con ésta, la de la comunidad humana en general. Hegel muestra que esta deducción de Fichte es contradictoria, y desde su crítica planteará un nuevo concepto de naturaleza. (shrink)

En el presente artículo se lleva a cabo un análisis comparativo de las concepciones fundamentales de la “autoconciencia” de J. G. Fichte y G. H Mead. Tal análisis busca demostrar, como tesis central, que ambas concepciones convergen en la configuración de una idea del sujeto autoconsciente en la que la interacción intersubjetiva se pone a la base de condición de posibilidad del “yo” (Fichte) o del “sí mismo” (Mead). Esta demostración obliga a explicitar los modelos de intersubjetividad que subyacen a (...) las respectivas nociones de autoconciencia, representados, en el caso de Fichte, en la teoría de la “exhortación” y, en Mead, en la teoría de la “asunción de roles”. En esta exploración se busca poner de manifiesto que ambas nociones describen un orden de la intersubjetividad práctica en virtud de la significación normativa contenida en ambos modelos, es decir, en virtud de las actitudes y comportamientos que exigen de los sujetos para toda relación intersubjetiva lograda. Esta significación normativa permite apropiarse finalmente del sentido último que encierran ambas nociones de la autoconciencia: el que ésta es, para ambos pensadores, un fenómeno posible sólo por la mediación social que le precede y en la que se halla originariamente inmersa. The literary genesis of Einbahnstraße by Walter Benjamin represents a very special case of the use of the procedures of surrealism in the philosophical-literary production of the author. The process of evolution of thinking that ended up in the writing of this piece is unveiled throughout the present analysis. This is a sign of both waiver and restart; the opening for a new productive dimension in the career of one of the most important —and misunderstood— philosophers of the 20th century. (...) This paper deals with the question of whether uncertainty regarding model structure, especially in climate modeling, exhibits a kind of “chaos.” Do small changes in model structure, in other words, lead to large variations in ensemble predictions? More specifically, does model error destroy forecast skill faster than the ordinary or “classical” chaos inherent in the real-world attractor? In some cases, the answer to this question seems to be “yes.” But how common is this state of affairs? Are there precise mathematical (...) results that can help us answer this question? And is dependence on model structure “sensitive” in that arbitrarily small errors can destroy forecast skill? We examine some efforts in the literature to answer this last question in the affirmative and find them to be unconvincing. (shrink)

El artículo aborda la responsabilidad médica penal por omisión en situaciones de emergencia de salud, debido a las dudas que aún existen sobre el accionar médico en estas circunstancias y las posibles consecuencias jurídicas por negligencia, impericia e imprudencia. La responsabilidad médica incluye la obligación moral de responder de los propios actos y reparar o indemnizar las consecuencias perjudiciales para terceros. Se identifican las falencias en las normativas ecuatorianas con relación al actuar médico en situaciones de emergencia de salud y (...) se busca aportar a la academia con publicaciones de conocimiento. Se analizan los elementos normativos y fácticos de la responsabilidad médica penal por omisión en situaciones de emergencia de salud en la República de Ecuador, y se busca identificar el marco normativo en la legislación ecuatoriana para superar la inadecuada actuación médica en estas situaciones. El conocimiento de la normativa legal contribuye a superar la responsabilidad médica penal por omisión en situaciones de emergencia en el Ecuador y se menciona y se analiza el art.146 del COIP que es la normativa vigente. El artículo concluye que el objetivo no es criminalizar la práctica médica, ya que no toda muerte es homicidio y no todo proceso judicial implica el encarcelamiento de los involucrados. (shrink)

In this essay I revise, based on the notion of the ‘enlightened ruler’ or mingzhu and his critique of the literati of his time, the common belief that Han Fei was an amoralist and an advocate of tyranny. Instead, I will argue that his writings are dedicated to advising those who ought to rule in order to achieve the goal of a peaceful and stable society framed by laws in accordance with the dao.

In recent decades, the expansion of economic activity has been accompanied by negative environmental impacts. In response, there have been dramatic changes worldwide in terms of an increased demand for environmentally friendly products and services. To achieve these eco-innovations, firms have sought to acquire knowledge and implement operational flexibility by cooperating with different agents such as universities through a value cocreation system that is also expected to enhance firms’ performance. Using a sample of 250 companies, the present paper examines the (...) role of cooperation with universities in the development of diverse environmental innovations and building operational flexibility and, through this, improving firm performance. Results show that firms that value cooperation with universities develop a wider range of environmental innovations and increase their sales and benefits. (shrink)

Argumentation represents a way of reasoning over a knowledge base containing possibly incomplete and/or inconsistent information, to obtain useful conclusions. As a reasoning mechanism, the way an argumentation reasoning engine reaches these conclusions resembles the cognitive process that humans follow to analyze their beliefs; thus, unlike other computationally reasoning systems, argumentation offers an intellectually friendly alternative to other defeasible reasoning systems. LogicProgrammingisacomputationalparadigmthathasproducedcompu- tationallyattractivesystemswithremarkablesuccessinmanyapplications. Merging ideas from both areas, Defeasible Logic Programming offers a computational reasoning system that uses an argumentation engine (...) to obtain answers from a knowledge base represented using a logic programming language extended with defeasible rules. The thought of Pierre Klossowski, praised by Foucault, Blanchot, Deleuze, has been scarcely addressed by the philosophical community. We argue in this article that this is largely due to the frequent difficulty of understanding his work as a whole: both his artistic and literary production and his interpretations of Nietzsche or Sade form a coherent whole, whose significance has a deeply critical political scope. The notion of unproductive spending, which occupies a central place in Bataille's work, will be rearticulated in (...) Klossowski's reflections through the concepts of drive, phantasm, simulacrum, value and consumption. In The Living Currency, the political dimension of these terms appears clearly: relying on a rereading of Fourier and Sade, the author shows the extreme degree of deformation of what we assume as a reality in modern industrial society. In this sense, his thinking takes on special relevance today, as a revelation of the excess and unhingedness of a society in which production and consumption are reproduced without limit through the infinite reflections produced by the game between drives, ghosts and simulacra. In a recent issue of the Journal of Business Ethics, Filipe M. Santos posits that social entrepreneurs maximize not on value capture, but on value creation, only satisficing on value capture to fuel operations, reinvesting in growth, whatever the specific combination of institutional means is deemed appropriate. No doubt the analytical framework of value creation and value capture casts new light on the phenomenon of social entrepreneurship, but we think Santos is asking too much by advocating a shift in focus (...) away from the organization. On the contrary, we maintain that by refocusing the theory on the organizational level and away from the system it is possible to understand that not all organizational solutions available to social entrepreneurs are able to create value and not all value capture strategies can serve a social goal. Indeed, there is only one form of organization that fulfills the criteria of maximizing on value creation, while satisficing on value capture and that is the social enterprise. (shrink)

Citizenship regimes are institutionalized systems of formal and informal norms that define access to membership, as well as associated rights and duties. This paper studies illegalized migration as one of the major tests to assess whether citizenship regimes are fair institutions, based on a historical analysis of legislation meant to reduce illegalized migration in the United States between 1995 and 2022. We build our empirical research starting from a simple observation: despite the great number of bills introduced to reduce illegalized (...) migration to the US, most of such initiatives fail to become law. In fact, 93.5% of all immigration initiatives did not even pass the chamber of Congress in which they were originally presented. Such a high rate of failure shows that these proposals are motivated by electoral aspirations, rather than coming from a genuine wish to help migrants or grant them citizenship. Furthermore, there is also an economic interest that justifies the maintenance of low-cost disposable immigrant labor, with no right to citizenship. Our analysis is an example of how state regulation processes seem to work to formalize, rather than alleviate or eradicate, the precarious legal statuses of illegalized migrants. We conclude that a globalized phenomenon such as citizenship requires going beyond merely institutional and formal conceptions. We need to rethink the institutional notion of citizenship, as a merely status held under the authority of a state and consider it from a cosmopolitan perspective and a multilateral basis. But as long as citizenship remains under the responsibility of states, illegalized migrants will continue to experience precarious citizenship. (shrink)

This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . Nudging and sludging are forms of choice architecture that shape behavior. While it is generally believed that nudging should improve well-being and sludging should decrease it, there has been debate about how to distinguish between the two. Some have suggested that the difference lies in the ease with which behaviors are facilitated or hindered, but this criterion does not consider the normative distinction (nudges have a positive connotation and sludges a negative one) or the impact on well-being. This paper proposes (...) a normative approach to defining nudging and sludging that takes into account both well-being and the principle of autonomy. According to our proposal, the concept of nudging should involve interventions that aim to increase well-being while respecting individuals’ freedom of choice, while sludging involves interventions that decrease well-being while also respecting autonomy, whether intentionally or unintentionally. Teacher quality, its effect on students’ outcomes, and the association of these with economic growth, is the core of recent discussions in Latin America given the region’s weak results in international learning assessments. This paper investigates whether there is an effect of philosophy on the outcomes of critical reading for students in B.Ed. programs in Colombia. Relying on exact matching combined with propensity score matching with regression adjustment, we use national data from Colombia to show that students in B.Ed. in (...) philosophy outperformed students in other B.Ed. in critical reading test (0.401–0.124 SD), and, importantly, with higher effects observed for students with lower prior academic achievement (0.44 SD). This suggests that philosophy can help to narrow educational outcomes of students whose socioeconomic conditions are disadvantageous, contributing to social justice in education. (shrink)

It is commonly accepted that Han Fei studied under Xunzi sometime during the late third century BCE. However, there is surprisingly little dedicated to the in-depth study of the relationship between Xunzi’s ideas and one of his best-known followers. In this essay I argue that Han Fei’s notion of xing, commonly translated as human nature, was not only influenced by Xunzi but also that it is an important feature of his political philosophy.

Since the concept of “nudge” was introduced in 2008 by Thaler and Sunstein, proposing that small interventions based on changes in choice architectures can alter people’s behavior and make it easier for them to achieve their desired goals, the application in public policy of behavioral economics has gained significant attention. This has led to the emergence of different types of policies based on behavioral insights, which have been used in a variety of areas, including health or finance, with the goal (...) of promoting well-being and addressing social and economic issues. After providing a basic theoretical background as a frame of reference to understand gender violence, this study explores the use of tools from the field of behavioral economics as it is applied in public policy. Regulatory (paternalistic) and non-regulatory (libertarian) interventions based on behavioral insights will be considered: nudges, boosts, shoves, budges, or sludge audits, are examined as potential interventions to use in matters related to this type of violence. After evaluating these behavioral policy instruments and their potential effectiveness, the limitations of the behavioral perspective are recognized, and the need for a multifaceted approach to combating gender violence is acknowledged. The article concludes by arguing that public policies addressing gender violence should not only utilize behavioral tools but should also incorporate strategies related to education, legislation, and social norms. Expresa el medio en que se efectúa la lucha de estos extremos, la muerte sacrificial, pero también el sentimiento de la íntima reconciliación entre los opuestos en disputa. Ever since Aristotle, ontology has been assumed to have a single meaning. Classic ontology branched into three directions established by Kant--the three chief manifestations of reality: cosmology, psychology, and theology--and in its quality of pure ontology became the study exclusively of being. On the other hand, the three dialectical branches have been losing their validity and are being replaced by regional ontologies which take explicit account of their several objects. Four territories today present themselves for intensive speculative cultivation; quantity, matter, (...) life, and spirit. Theology has returned to its classic position at the side of pure ontology. The ideas of object and of concept are radically opposite, but nevertheless are closely related in the context of knowledge; an object is the source of a concept. A concept is formed by one or several objective instances, but does not include all of them; there are more or less determinate objects, some of which have undergone conceptual modification while others remain quite obscure, all of which indicates that the world of reality is not so evident or firm as it appears to common sense. The ideas of being and of objects bring us again to the consideration of the metaphysical theme of the individual. Neither being nor object is the concrete individual; the problem of the individual remains involved in the whole problem of substance as it was discussed in classic metaphysics, because it was completely grounded in this metaphysics and is best discussed and appreciated as the problem of the incommunicable and subsistent. Regional ontology, in fixing its attention entirely on the object, thereby limits itself and makes clear its methodological orientation. Regional ontology by no means is to be considered as a theory of science; any theory, concrete or general is subject to a synthetic process in which facts and proofs immediately given incorporate the theory into the patrimony and positive achievements of intelligence. A theory is a scientific synthesis, and although its fundamental role is logical, its origin implies experimental functions. Regional ontology can be considered as a theory of objects, but its validation does not come from science itself; rather, it is the validation of scientific facts. Ontology might be called a theory a priori, but in that case the terms "theory" and "a priori" would be contradictory since the former requires experience and the latter renounces all experimental data. Ontology operates by means of general essences which objects of the same denomination have in common; thus we speak of the realm of quantity, the realm of matter, the realm of life, and the realm of spirit. The mathematical as well as the natural, biological, and spiritual sciences clearly have different objective planes which correspond to different ontological categories, which are foreign to the experiencing subject because it knows them only concretely as phenomena. The metaphysical basis of mathematics is quantity, a real accident of matter. Quantity examined according to the ontology of mathematics arises from matter, finding its origin in matter as the quality related to form. The ontology of the physicochemical sciences is concerned with the contents of quantity, with the internal object by which quantity is numbered and given its nature. Matter presents a problem to philosophy no less important than the problem it presents to the sciences whose data are mere approximations to matter. Natural sciences which seem very intelligible resolve themselves into a morass of questions when one tries to reduce them to science strictly so-called. In present-day philosophy we say that the nature and structure of objects and beings, both inorganic and organic, are in practice external to human action, taking "human" in the sense of spiritual being. The instability of living being, in contrast to the internal equilibrium of inanimate being, makes it appear less intelligible. On the plane of ontology of life, man is the central problem, even though he is one of the most definite and individualized of beings. Man's life culminates in freedom, which makes man a responsible being, in this respect resembling God. Though less unknown than mathematical, material, and biological objects, mental objects are more difficult and involve subtle and risky problems. The first great phenomenon offered to the philosophy which penetrates the field of the ontology of the social sciences is the identity between the object and the subject, since the subject, who as far as possible refers systematically to the pure object, continually treads the boundary of reality and arrives at himself; that is, the inquiring subject becomes simultaneously the object investigated--a kind of cognitive identity possible in reflection. The second problem of this field of philosophy is the consideration of "I" as absolutely empty of objectivity. For contemporary philosophy, spirit is the world of values, and it is not so important to determine the pure reality of spirit as to understand its life, its activity, and its specific manifestation which is the world of culture. The social sciences deal with man as a spiritual being, and with the facts of culture. The values produced by culture constitute a hierarchy which goes from the most humble to the most elevated, from plain economic interest to an intense desire for God. Culture is produced by the objectification of values; spirit becomes fixed in certain entities which are cultural objects: a theory, a machine, a concert. Man acts as the creator of a culture, but the culture in turn spiritually actuates and nourishes him. The sciences of spirit go from signs to their meaning, from the expression to the living. The point of departure in historical knowledge is our own vital experience, the very life which flows within us. Only life understands life. Here we find the reason why culture indicates the maximum expression of life; in culture, man contemplates himself, and in himself he contemplates all the beings of creation. (shrink)

El texto directriz para abordar este problema es el siguiente: El qué-era-el-ser de cada cosa es lo que se dice que ésta es en sí misma. No es empero posible desglosar este texto y acceder a su significado, sin ambientar antes a la luz de la pregunta por el ente en cuanto (...) tal y sin enfocarlo desde el contexto de la pregunta por la esencia. La interpretación más importante y discutida de Kant en los últimos años ha sido "Die Beweisstruktur von Kants transzendentaler Deduktion" -La estructura de la prueba de la deducción trascendental de Kant- de Dieter Henrich, aparecida en PRAUSS, Gerold. Kant. Para la intetpretación de su teoría del conocimiento y de la acción. Köln, 1973, p. 90-104. Mirada desde un punto de vista jurídico, la deducción prueba el origen del conocimiento puro y muestra los alcances y límites de sus pretensiones de legitimidad. (...) La deducción trascendental tiene como meta probar que hay un uso irrestringido de las categorías en la determinación de la multiplicidad dada. Henrich se centra en la prueba de la validez de los conceptos puros del entendimiento y su consecuente aplicación. La novedad, según Henrich, consiste en hablar, no de dos pruebas -como era tradicional- sino de una sola prueba en dos pasos, localizados en pasajes diferentes de la segunda redacción (B). El primero expone la restricción de la validez (15 - 21) y restricción (46). El primer pasaje muestra que todas las intuiciones que tienen unidad se hallan bajo el dominio de las categorías (20). Pero falta aún algo escencial en la primera parte de la deduccfón B para su completa realización. Se supera la restricción en el 26 con la tesis de la unidad de las intuiciones formales de espacio y tiempo. El presente artículo intenta hacer un análisis pormenorizado de los dos pasos de la prueba propuestos en la reconstrucción de Henrich, para cuestionar los presupuestos bajo los cuales puede entrar en vigor la prueba de la legitimidad y la ulterior aplicación de los conceptos puros del entendimiento.
